Deciding

One call, two Baldwinsville questions

Neither is a reason to panic and both are reasons to ask early. The exemption turns on the listing, so an atmospheric furnace replaced by a sealed combustion condensing one is the case to put to the village rather than to assume. The stretch code's own text conditions enforceability on a filing and a Code Council determination that this ledger has not traced, which is precisely why it is a question for the code office and not a requirement we will assert at your address. The housing is the practical backdrop: 779 of the village's 3,784 units were built in 1939 or earlier and 761 were built this century, so nothing about the existing venting can be assumed.

  1. Does the listing change

The village's exemption covers replacement that keeps the equipment's listing and original specifications. A condensing conversion is the case to ask about.

  2. What does the village energy code ask

Local Law No. 7 of 2022 adopted a stretch code applicable to altered buildings. The village code office is where its effect on your job is settled.

  3. No default Baldwinsville house

A fifth of the village is prewar and a fifth was built this century, so the existing vent arrangement has to be looked at rather than guessed.

The Village of Baldwinsville local law filed with the New York State Department of State states that a building permit shall be required for any work which must conform to the Uniform Code or the Energy Code, including the installation of a solid fuel burning heating appliance, chimney, or flue in any dwelling unit, and then lists the exemptions the village has adopted. They include installation of listed portable electrical, plumbing, heating, ventilation or cooling equipment or appliances, and replacement of any equipment provided the replacement does not alter the equipment's listing or render it inconsistent with the equipment's original specifications. The law adds that the exemption is not an authorization for work to be performed in violation of the Uniform Code or the Energy Code, and that no person shall commence work requiring a permit without first obtaining one from the Village Code Enforcement Officer.

Local Law No. 7 of 2022 of the Village of Baldwinsville adopts, as the village's local energy conservation construction code, the State Energy Code as modified in the manner contemplated by NYStretch Energy Code 2020, Version 1.0, dated July 2019, published by NYSERDA. Section 3 of the local law states that the local energy conservation construction code shall be applicable to all buildings constructed, substantially renovated, or altered in the village on or after the effective date of the law, and to all additions made on or after that date. The law records one carve out: section R403.6.2, added to the 2018 IECC by section 3.11 of NYStretch, shall not be deemed to be added. Section 3 also records the Energy Law section 11-109(2) filing condition that governs whether and when the local code is enforceable.

What furnace replacement involves

Local Context

The exemption and the stretch code, on the same Baldwinsville job

Baldwinsville has taken two decisions that no other municipality in this ledger has taken together. It adopted the optional exemption for replacement of any equipment provided the replacement does not alter the equipment's listing or render it inconsistent with its original specifications, and separately, under Local Law No. 7 of 2022, it adopted the State Energy Code as modified in the manner contemplated by NYStretch Energy Code 2020, applicable to buildings constructed, substantially renovated or altered in the village. So a furnace replacement here can raise a permit question and an energy code question at the same time, and one telephone call to the village code office covers both.

Questions

Baldwinsville furnace and code questions

Why does Baldwinsville have its own energy code?

It adopted one. Local Law No. 7 of 2022 adopts the State Energy Code as modified in the manner contemplated by NYStretch Energy Code 2020 as the village's local energy conservation construction code, applicable to buildings constructed, substantially renovated or altered in the village, with one carve out recorded in the law itself. What it requires of a particular job is the village's determination.

Does the replacement exemption cancel the energy code?

No, and the two should not be conflated. The exemption is about whether a building permit is required for a category of work; the energy code is about the standard the work is held to. The village's own exemption text states that it is not an authorization to perform work in violation of the Uniform Code or the Energy Code.
